Whilst the owners and employees of Functional Living are health professionals and the information provided on this website relates to modalities within the business’s area of professionalism, the content contained on this website is not a substitute or replacement for advice from a professional who can conduct a face-to-face personalised assessment. Results from undertaking the course content is not guaranteed, and may vary from person to person. Engaging in any of the treatment modalities may cause harm.

Neither Dione Brockwell, nor the employees of Functional Living shall be held liable or responsible for any errors or omissions within the material, and no assurance is given that the advice contained will always include the most recent findings or developments with respect to the particular material.

Your purchase of the content provided by Functional Living indicates your acceptance of the terms in this section.

COURSE ENROLMENT

1. There are no course or subject prerequisites for entry into our any of our courses
2. The material does require a level of cognitive understanding and discernment to ensure that no harm is undertaken with the strategies provided
3. The participant accepts that they are required to pay the full amount of the course fee upfront before being given access to course content
4. One (1) participant per course enrolment
5. Course commencement is effective from the date that payment funds are received
6. Course duration is effective for 12 months, with access to the course content expiring at this time
7. The participant agrees to keep their password confidential and be responsible for all uses of their account and password
8. Special offer coupon codes cannot be added to an enrolment retrospectively and must be added at the time of checkout/enrolment
9. Courses may be transferable (see Course Refunds and Transfers)

COURSE MATERIALS AND ACCESS

1. Course material is supplied in an online environment
2. Some courses have the option of downloading and printing specific material
3. The content of the online courses, including copyright and all other intellectual property rights contained therein, remain the property of Functional Living. You may not reproduce any part of the online course materials without the prior written consent of Functional Living
4. Course content and materials are subject to change without notice
5. The courses are self-paced
6. Course access is available for 12 months, with extensions available upon application (fees apply)

COURSE REFUNDS AND TRANSFERS

1. If the course content is not what you hoped it would be, you have eight (8) business days after you start the course to request a refund
2. After eight days duration from course commencement, or before the start of the Treatment Strategies module, you are no longer eligible for a refund
3. If the refund deadline for a course has passed, you may request an exception in writing, usually via email outlining your justification for a refund. Functional Living reserves the right to approve or deny any such request
4. Course transfers are only permitted if the original paid course content has not commenced. If the course you are transferring into is of a lesser value, a credit voucher/refund will be issued. If the program you are transferring into is of a higher value, the difference in value will be payable

CONFIDENTIALITY AND PRIVACY POLICY

We will make reasonable efforts to keep any such information that we have about you secure, and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.

We will only disclose information that we have about you:

1. to the extent specifically required by law; or
2. for the purposes of this agreement (including disclosing information in connection with any query or claim)
3. information provided by you is considered confidential and will not be divulged to any third party, nor will it be sold

MARKETING COMMUNCIATIONS

Upon enrolment into the course, we may use the content from your emails in our marketing materials and on our website testimonials page, as well as send you a monthly newsletter. Your identity will never be revealed. Please be assured that we respect your privacy and only comments related to course outcomes and client experiences will be mentioned.
